This policy (“Privacy Policy”) sets out the basis on which any Personal Data We collect from You, or that You provide to us, will be processed by Us.

Your privacy is very important to us. We are committed to ensuring that when You use Our Service, You know what Personal Data We collect about You and how We use it. We want this Privacy Policy to be as clear, simple, and fully transparent as possible. 

In processing Your Personal Data We will comply with the General Data Protection Regulations (EU) 2016/679, the Data Protection Act 2018 – Chapter 586 of the Laws of Malta (and any regulations made thereunder), and the Privacy and Electronic Communications (EC Directive) Regulations 2003 (as amended), as well as any other data protection laws that apply from time to time (together with the “Data Protection Laws“).

The Seeking Travels ; is the data controller of Your Personal Data under the Data Protection Laws in relation to Personal Data collected. As a data controller We determine the purposes and means of processing the Personal Data that We collect and are responsible for Your data. 

  • INTERPRETATION AND DEFINITIONS

The interpretation and construction of this Privacy Policy shall be subject to the following rules, except where the context makes it clear that a rule is not intended to apply:

  • Headings are for ease of reference and shall not affect the interpretation of this Privacy Policy;
  • A word which suggests one gender includes the other genders;
  • Capitalised terms used in this Privacy Policy shall have the meanings set out below, whether used in the singular or in plural form;

The following words and/or expressions shall have the following meanings:

    •  “Company” (referred to as either the “Company”, “We”, “Us” or “Our”) means Seeking Travels
  • “Personal Data” means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

 

  • “Service” means the Company’s website and any related services provided through it;
  • “Website” means the website operated by the Company 
  • “You”, “Your”, “Customer” means the individual making or benefiting from a booking through the Company, whether directly or via an intermediary. Where a booking is made on behalf of more than one person, all such persons shall be deemed Customers, and this Privacy Policy shall apply equally to each of them.
  • HOW IS YOUR PERSONAL DATA COLLECTED?

When You request a quotation, confirm a booking, or submit personal information to Us about You and about any other person You include on Your request for a quotation and/or booking, You acknowledge and accept that such information may be collected, stored, transferred, and processed in accordance with this Privacy Policy. We are committed to taking appropriate and reasonable safeguards to protect Your Personal Data and handle it securely. Personal Data may also be collected through:

  • Our Website
  • Emails you send to us, or that we send to You;
  • Our online conversations with You; and
  • Your use of social media to follow us, buttons and similar functions made available by social media platforms.

When You browse our Website, We automatically collect identifiers such as cookies and IP addresses and other technical data, such as browser type and version and operating system and platform, location data and login data, as well as usage data including information about how You use Our Website, products and services.

 

Personal Data is required in order for Us to make the necessary travel arrangements requested by You. In certain circumstances, We may also need to collect special category data, including information relating to Your health, which will only be processed with Your explicit consent.

 

  • HOW WE USE YOUR PERSONAL DATA

We will only use Your Personal Data when the law allows us to. Most commonly, We will use Your Personal Data in the following circumstances:

  • In order to perform the contract, We are about to enter into or have entered into with You;
  • Where it is necessary for Our legitimate interests (or those of a third party);
  • Where We need to comply with a legal obligation;
  • To carry out Our obligations arising in connection of any booking;
  • To communicate with You regarding Your booking;
  • To notify You about any changes to Our Service.

If You have made a request for a quotation or booking, Your Personal Data may be used by Us to contact You by post and/or by electronic means with information and offers relating to products or services similar to those about which You enquired or which You purchased. We will only do this if You did not opt out of such marketing at the point where We collected Your contact details.

You have the right at any time to ask us not to process Your Personal Data for marketing purposes. You can exercise Your right to prevent such processing by ticking/un-ticking certain boxes on the forms We use to collect Your data.   • WHO WE DISCLOSE YOUR PERSONAL DATA TO

Your personal data may be disclosed to and processed by Our employees provided that they have a job-related need to know the Personal Data in order to carry out the processing for the purposes set out in this Privacy Policy. 

Upon making a booking with Us, some of the Personal Data will need to be passed to, processed and stored by relevant third parties, such as hoteliers, payment providers, airlines, insurance companies (if applicable), so that they can provide You with the arrangements you require. Some of these third parties may be based outside of the European Economic Area (EEA). 

Whenever We transfer Your personal data outside of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer Your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.
  • Where we use certain service providers, We may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe.

If You follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies.   • SECURITY OF YOUR PERSONAL DATA

We have put in place appropriate security measures to prevent Your Personal Data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. All information You provide to Us is stored on Our secure serversIn addition, We limit access to Your Personal Data to those employees and/or agents on a need-to-know basis. They will only process Your Personal Data on Our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected Personal Data breach and will notify You and any applicable regulator of a breach where We are legally required to do so.

  • HOW LONG WE KEEP YOUR PERSONAL DATA FOR:

We will only retain Your personal data for as long as necessary to fulfil the purposes We collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which We process Your Personal Data and whether We can achieve those purposes through other means, and the applicable legal requirements. No Personal Data that We process will be kept longer than necessary for the purposes for which it is processed. 

  • YOUR LEGAL RIGHTS

Your rights under the Data Protection Laws in relation to Your Personal Data include (but are not limited to) the following:

  • You have the legal right to ask Us to supply you with a copy of the Personal Data that We hold about You at any time free of charge. This could include booking information. Further copies may incur a reasonable fee and also if Your request is clearly unfounded, repetitive or excessive (we may refuse to comply with your request in these circumstances). Any such requests must be made in writing to

  • You can also ask Us to rectify any errors in Your Personal Data or complete any incomplete data that We hold or You can update Your own details at any time by accessing your online account. Any such requests must be made in writing to seekingtravelsmalta@gmail.com
  • Where You have given your consent to Our processing of Your Personal Data, You have the right to withdraw Your consent at any time. If You withdraw Your consent and there is no other legal ground for Us to process Your data, You can ask Us to erase Your personal data. You can also require Us to erase your data if We have processed Your data unlawfully or if the law requires Us to erase Your data. Note, however, that We may not always be able to comply with Your request of erasure for specific legal reasons which will be notified to You, if applicable, at the time of Your request.

 

  • You may also restrict the processing of Your data: This enables You to ask Us to suspend the processing of Your personal data if: (a) if You want us to establish the data’s accuracy; (b) where Our use of the data is unlawful but You do not want Us to erase it; (c) where You need Us to hold the data even if We no longer require it as You need it to establish, exercise or defend legal claims; or (d) You have objected to Our use of Your data but We need to verify whether We have overriding legitimate grounds to use it.

 

  • You may request the transfer of Your personal data to You or to a third party. We will provide to You, or a third party You have chosen, Your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which You initially provided consent for Us to use or where We used the information to perform a contract with You. Additionally, We bind ourselves to notify You, without undue delay, should there occur a breach of Your Personal Data.

 

  • You have the right to make a complaint at any time to the Office of the Information and Data Protection Commissioner (IDPC), the supervisory authority for data protection issues (https://idpc.org.mt/). We would, however, appreciate the chance to deal with Your concerns before You approach the IDPC so please contact us in the first instance.

 

  • You have the right to erase Your Personal Data at any time, subject it that doesn’t compromise the ability to research and any legal requirements can be exercised in accordance with the regulation. Any such requests must be made in writing to seekingtravelsmalta@gmail.com

The Company reserves the right to update or alter its Privacy Policy at any time. Any amendment will take effect immediately after publishing. The Company recommends that you refer to the Privacy Policy prior to travel to familiarise yourself with the most up-to-date version available.
